The International Charitable Foundation is guided by the provisions of the current insurance legislation of Ukraine in providing financial assistance to victims of road accidents. The Foundation’s only reliable partner in this area is the MOTOR TRANSPORT INSURANCE BUREAU OF UKRAINE (MTIBU) – non-entrepreneurial (non-profit) organization, which is the only association of insurers carrying out compulsory civil liability insurance (CCLI) of owners of land vehicles for damage caused to third parties. MTIBU currently has 42 insurance companies as members.
Payment of insurance compensation to the victims of road accidents is carried out in accordance with the conditions established by the legislation about CCLI of the country, where the road accident occurred. From September 21, 2019 in accordance with the Order of National Commission for State Regulation of Financial Services Markets №538 dated April 09, 2019, the insurance amounts under internal contracts of compulsory civil liability insurance in Ukraine are set in the following amount:
In case of registration of electronic Euro protocol (a simplified mechanism of road accident registration without victims and calling the National Police), in accordance with the Order of National Commission for State Regulation of Financial Services Markets №3471 dated December 29, 2015, insurance indemnity is 50 000 UAH.
MTIBU:
– from the foundation of the protection of victims (under internal contracts, including in cases where the culprit of a road accident does not have insurance policy); of damage caused by a person who is exempt from the obligation to insure their civil liability, as combatants, disabled war veterans, disabled people of the first group; of damage caused by an unidentified vehicle; of bankruptcy or liquidation of the insurer-member of the Bureau, other cases);
– from the foundation of the insurance guarantees (under international treaties “Green card”);
